Terms and Conditions

All material is guaranteed to be as specified. All work in a workmanlike manner according to standard practice. Any alteration or deviation from the above specifications involving extra costs will be executed only upon written orders and may become an extra charge over and above amount stated above. All agreements are contingent upon delays or incidents beyond our control. Owner to carry fire and property insurance. Our workers are fully covered by workman's compensation Insurance.

Under New York State Lien Laws any contractor, subcontractor, laborer or supplier not paid for the work performed or the materials or services supplied, has claims that may be asserted against you and your property. All deposits or advances will be placed in an escrow account within five business days with M&T Bank of Endicott, New York.

Contingencies that could affect the start, substantial completion, and/or final completion date are:         -Weather conditions that prevent safe or effective working conditions.    -Delays in obtaining materials caused by circumstances beyond CONTRACTOR”S control    -Delays from previous jobs scheduled before your project.    -Changes in the work requested by CUSTOMER and agreed to by CONTRACTOR    -Unless otherwise stated, delays caused by the above contingencies shall prolong the work on a day to day basis.

Any contractor, subcontractor or material man who provides home improvement goods or services pursuant to this contract and who is not paid may have a valid legal claim against your property known as a “mechanic’s lien”.  Any mechanic’s lien may be discharged. Payment of the agreed upon price under this contract prior to the filing of a mechanic’s lien may invalidate such lien. The Customer may contact an attorney to determine his/her right to discharge a mechanic’s lien.

Limited Workmanship Warranty: The Contractor agrees to repair or replace at the Contractor's expense for a period of one year from completion of installation, any part of the Product specified in this agreement, which upon Contractor's inspection proves to be defective. All Implied Warranties are limited in duration to the one year warranty period. Accordingly, any such implied warranties including merchantability, fitness for a particular purpose, or otherwise, are disclaimed in their entirety after the expiration of the one year warranty period. The obligation under this warranty is strictly limited to the repair or replacement of defective parts. Owner agrees to pay reasonable collection fees.

Extended Limited Workmanship Warranty for Epoxy and Polyaspartic Installations: The Contractor agrees to repair or replace at the Contractor's expense for a period of one year from completion of installation, any part of the Product specified in this agreement, which upon Contractor's inspection proves to be defective. For a period of 10 (Ten) years from the date of installation the Contractor agrees to provide the full cost of labor to repair or replace at the Contractor's expense for a period of one year from completion of installation, any part of the Product specified in this agreement, which upon Contractor's inspection proves to be defective.  The customer will be responsible to pay for all materials to repair or replace at the Contractor's expense for a period of one year from completion of installation, any part of the Product specified in this agreement, which upon Contractor's inspection proves to be defective.  All Implied Warranties are limited in duration to the ten (10) year warranty period. Accordingly, any such implied warranties including merchantability, fitness for a particular purpose, or otherwise, are disclaimed in their entirety after the expiration of the one year warranty period. The obligation under this warranty is strictly limited to the repair or replacement of defective parts. Owner agrees to pay reasonable collection fees.

I have read the attached colorant and sealer application  disclaimers and have been completely educated on the sensitive and permanent nature of this type of application and hereby agree that payment for services will not be effected or withheld due to any discrepancy related to the following attached articles.

Any and all permits for any installation Starkrete is to perform is the responsibility of the Homeowner/Customer to acquire at their own cost, separate and above from any Contract or Agreement with Starkrete, from their respective building code authority.

Colorant & Sealer Application
Disclaimer and Acknowledgement Section:

​

New Concrete Product Disclaimer:

•    The finished product will be in compliance with industry standards. The finalized product will be an average of 4” in thickness for all foot traffic areas, and an average of 6” in thickness for any product that requires vehicle traffic.

•    The final product will have proper amount of slope for drainage. The slope may have some variation due to the textured stamp.

•    The finalized product may have slight variations in texture and levelness due to the textured stamp.

•    The finished product may have slight variation in the smoothness of the edging due to the physical pressure executed or the walls of the frame due to the stamping process.

•    Control Joints are going to be placed in your concrete to allow for movement. They are intended to minimize cracking in the concrete.  However, cracks may still occur even with the placement of control joints.  They will be made using a hand held saw, therefore; they will not be perfectly straight.

•    A reasonable amount of damage to the customer's property may occur throughout the course of your construction project.  Customer is responsible to mark out underground wires, drainage, etc… so contractor does not hit lines.
(ex. lawn damage due to wetness of ground or washing of concrete tools & equipment)

Coloring:

•    Concrete coloring will have varied results in appearance depending on, temperature, sunlight, and other natural elements.

•    Integral concrete coloring is applied throughout the entire bath of concrete.  Therefore, the color will remain even if the concrete surface is abraded.

•    Acid stain, concrete dyes, concrete stains and color hardener are coloring products applied to the concrete surface only.  Therefore, any abrasion to the concrete surface will remove the color.

•    Color charts are not an exact representation of the final product color. Samples are an approximation of color and do not denote the texture/sheen. Colors are subject to normal industry variation and vary with each surface and application method.

•    A sample board is a representation of the finished product and is always recommended but will not guarantee exact color and texture of the finished product. We do not assume responsibility for shade variations between sample boards and final products.

•    Natural elements may cause variations in color, texture, and random “mottling” making a predetermined effect or exact color matching non-applicable.

Sealer:

•    The surface sealer product being applied reacts with the minerals in the surface of the concrete to achieve its strength, durability, and protection from natural elements.

•    The concrete sealer is a sacrificial surface applied on top of the concrete.  Just like wax on a floor, when the sealer or wax is worn or abraded, the surface underneath becomes unprotected.

•    Concrete sealer may and most likely will darken the finished color. 

•    Applying surface sealer is always recommended to protect the finished product from natural elements; however, it may and most likely will cause the finished surface to become more slippery.

•    Applying anti skid aggregate to the concrete sealer is always recommended but will not guarantee a completely non slip surface.
 
•    The concrete sealer lifespan varies due to natural elements, foot and vehicle traffic, power washing, and other forms of wear and tear.

 

Concrete Resurfacing/Overlay Product Disclaimer:

​

•    The concrete resurfacing product is applied uniformly over the entire concrete surface at a depth of ¼” for floor surfaces.  Therefore, this product will not change slope of the existing surface.  This product will only be used to level or change the slope of the existing surface if specified on the contract.

•    The warranty excludes damages caused by failure of any previous coating, failure of substratum or damage caused by physical abuse, including , but not limited to, scratches from abrasive objects or materials and spills from gasoline, battery acid, paint remover, insecticides, and fertilizer, or a previous sealer coating wearing off (Contractor must be made aware of any previous sealers and documented on the contract)

•    The concrete resurfacing product being applied relies on the integrity of the existing concrete.  Movement, heaving, cracking, and the like occurring in the existing concrete can cause a negative outcome in the resurfacing product.  These include but are not limited to delamination, cracking, and chipping

•    If the area that is being overlaid has Control Joints, then we are going to re-cut Control Joints in your concrete to allow for movement. They will be made using a hand held saw; therefore, they will not be perfectly straight.

•    The coating is not indestructible and some care in protecting the surface is necessary. Please see the Starkrete  “Care Card”

•    The concrete overlay process is a process that may show any existing GRAIN, BLEMISHES, CRACKS, EXPANSION JOINTS, HOLES, TROWELING or TEXTURE in the concrete surface.

•    Existing cracks re-appearing after Starkrete coating has been applied are not covered under warranty.

•    A reasonable amount of damage to the customer's property may occur throughout the course of your construction project. 
(ex: lawn damage due to wetness of ground, or washing of concrete tools & equipment)

•    Color charts are not an exact representation of the final product color. Samples are an approximation of color and do not denote the texture/sheen. Colors are subject to normal industry variation and vary with each surface and application method.

•    A sample board is a representation of the finished product and is always recommended but will not guarantee exact color and texture of the finished product. We do not assume responsibility for shade variations between sample boards and final products.

•    Natural elements may cause variations in color, texture, and random “mottling” making a predetermined effect or exact color matching non-applicable.
•    Epoxy is subject to discoloration or “yellowing” over time due to exposure to UV light.  Please be aware that our epoxies have a UV stabilizer in them, but that only prolongs the discoloration.

Sealer:

•    The surface sealer product being applied reacts with the minerals in the surface of the concrete to achieve its strength, durability, and protection from natural elements.

•    The sealer is a sacrificial surface applied on top of the concrete.  Just like wax on a floor, when the sealer or wax is worn or abraded, the surface underneath is unprotected.

•    Concrete sealer may and most likely will darken the finished color. 

•    Applying surface sealer is always recommended to protect the finished product from natural elements; however, it may and most likely will cause the finished surface to become more slippery.

•    Applying anti skid aggregate to the concrete sealer is always recommended but will not guarantee a completely non slip surface.
 
•    The concrete sealer lifespan varies due to natural elements, foot and vehicle traffic, power washing, and other forms of wear and tear.

•    The warranty excludes damages caused by failure of any previous coating, failure of substratum or damage caused by physical abuse, including , but not limited to, scratches from abrasive objects or materials and spills from gasoline, battery acid, paint remover, insecticides, and fertilizer.

•    The sealer is a sacrificial surface applied on top of the concrete.  When the sealer or wax is worn or abraded, the surface underneath is unprotected.  Therefore, the sealer or wax will need to be re-applied periodically. 

•    Applying surface sealer is always recommended to protect the finished product from natural elements; however, it may and most likely will cause the finished surface to become more slippery.

•    Applying anti skid aggregate to the concrete sealer is always recommended but will not guarantee a completely non slip surface.
 
•    The concrete sealer lifespan varies due to natural elements, foot and vehicle traffic, power washing, and other forms of wear and tear.
IMPORTANT!
This is a “faux-finish” application and is an artistic attempt to recreate a natural look, theme, or antiqued weathered aged appearance in or on existing concrete.

Due to the chemical and permanent nature of the product being applied the application will not be subject to “artistic interpretation” or dispute

Concrete Counter top Product Disclaimer:


•    The Customer should assume a reasonable amount of dust will be created from polishing the concrete counter tops.
•    Tools and equipment to create the countertops will need to be washed off on the customers property, which will create a small mess.
